Imagine something goes wrong at your gate tonight. Could you show exactly who, when and how? Read on: it takes a few minutes and could save you a lot more than that. **In this guide you will see:** - No cameras where people expect privacy. - Don't point cameras into neighbours' property. - Tell employees and visitors they are being recorded. Quick answer Kenya's Constitution (Article 31) protects privacy, and the Data Protection Act, 2019 governs recording people's images. Cameras must not be placed where people expect privacy: bathrooms, toilets, bedrooms and changing rooms. Recording secretly, or pointing cameras into a neighbour's home or compound, risks complaints to the Office of the Data Protection Commissioner (ODPC) and court action. Visible cameras with clear notices are the safe approach. [Photo: Alan J. Legal commentators have questioned parts of the ruling, but it shows courts take camera angles seriously. ## Running CCTV lawfully 1. **Have a clear purpose**: Security of your property or premises. 2. **Put up notices**: Signs at entrances saying CCTV is in operation and who runs it. 3. **Aim cameras at your own property**: Use privacy masking for parts of neighbours' compounds in view. 4. **Tell staff**: Employers should inform workers of the presence, purpose and scope of cameras. 5. **Protect footage**: Limit who can view it, keep it only as long as needed. **Important**: Businesses processing personal data may need to register with the ODPC. Check with the ODPC or a data protection lawyer for your situation. ## Hidden cameras at home A visible camera deters intruders; a hidden one only records them. If you use a discreet camera in your own home for security, keep it out of private areas and never use it to record others where they expect privacy. Qyvea designs CCTV with privacy masking and proper notices. Secret recording of people without a lawful basis, especially in private spaces, can breach privacy and data protection law. Can my neighbour's camera face my compound?
